Legally, are you retarted?



WHo cares. Its myspace.



And if you put it out there in public, its the publics. Its not yours anymore.



SO if you want your pictures to stay your own, dont put them on myspace.



If they are using you name, social, and other id, then you might have something. Also if they are going around, writing things that are said to be from you, then you can get them on slander. But if they are just using your pictures, you out of luck.



Its like on halloween, when you leave candy on the corner in a bowl, people come and take it, you cant call the cops and say they stole your candy.

I think it depends on the extent of what the pictures are, or if you're making money of these pics. If its harmless and doesn't involve anything that is against the law the worst that can happen is you get your myspace account deleted.

No. There are no statutes concerning identity and pictures with respect to social websites. Sure, there are violations if you post child porn and stuff like that, but misleading pictures on a social website with no other felonious intent are generally not illegal (yet).

I once made a myspace for a friend of mine and photoshoped his head on his girlfriend, so in the pic it looked like he was hugging himself. I then subsequently friended all the myspace trash I could find. After I had a few hundred friends I showed him...he laughed...it was all good.



Personal photos are not copywrited. So there is no infringement there. However it could be considered person defimation in which case they could press charges and then subsequently get laughed out of court.



You can get away with it...just be nice.

From a legal standpoint there is potentially a lot that COULD happen but likely very little that would. If the picture is of a celebrity or some other well known figure than you are violating multiple copyright laws by using those pictures on myspace. The copyright laws do not specify that you need to make money from the picture, only that you use them without proper consent. Scott Adams has had many people tell them how they use his Dilbert comic in their personal presentations. He asks for their business card, then sues them. Additionally, if you are claiming to be the individual in the photo you could be guilty of Identity Theft.



In the case of misuse of the photo's you'll most likely have your account erased as it would be extremely costly to prosecute or sue you. On the Identity Theft, it's hard to say as the government is beginning to pursue this crime very heavily. Of course, in either case they have to find you which implies that the information you gave MySpace was accurate or they have the warrants to obtain your IP address.



Best advice: Don't use photo's that aren't yours, but if you do, don't pretend to be that person.

That depends on the picture. But such situations are rare and unheard of. 99% of all sites on the web use "borrowed" artwork.
